Terms compounding. In contrast to the elder style of Ascham and Elyot which it assaults, it is a clear, flowing, orderly and relatively pure style, with a systematic if monotonous formula of antitheses and similes. Let any one call you at any time, however fast asleep you may be, you make out their voice in the first surprise to be like some one’s you were thinking of in your sleep. The simple wants of the child are never exactly the same in themselves, the accidental circumstances with which they are combined are necessarily varying every moment, nor are the sentiments and temper of the father less liable to constant and imperceptible fluctuations. I have been assured by a person who had the best means of knowing, that the _Letter to a Noble Lord_ (the most rapid, impetuous, glancing, and sportive of all his works) was printed off, and the proof sent to him: and that it was returned to the printing-office with so many alterations and passages interlined, that the compositors refused to correct it as it was—took the whole matter in pieces, and re-set the copy. I have also observed a sort of _fatuity_, an indolence or indocility of the will to circumstances, which I think has a considerable share in the common affairs of life. Gout, for instance, gave rise to doubt, and some authors were found to affirm that they knew of cases in which gouty patients had been cured by a brisk application of the implements of the _marter-kammer_ or torture-chamber.[1669] Other legists gravely disputed whether in the case of epileptics the judge should bear in mind the aspects of the moon and the equinoxes and solstices, at which times the paroxysms of the disease were apt to be more violent. The astute lawyers who composed the royal court knew too well the work committed to them to hesitate as to their conclusions, while Philippe’s distaste for the duel probably received a stimulus when, at the Council of Vienne in 1312 he endeavored to obtain the condemnation of the memory of Boniface VIII., and two Catalan knights offered to prove by the single combat that the late pope had been legitimately elected and had not been a heretic.[751] In spite of these efforts, the progress of reform was slow. When we call a mode of doing a thing a fashion, we imply, quite unknowingly perhaps, that it has not the cachet of a change for the better, and that as such it has no security of tenure. As long as they do not allow themselves to be transported to do anything contrary to justice or humanity, they lose but little reputation, though the serenity of their countenance, or the composure of their discourse and behaviour should be somewhat ruffled and disturbed. It is accordingly universally acknowledged, that in these imitations this great master has been remarkably successful; and yet, unless the verses of Milton explained the meaning of the Music, it might not even in this case readily occur to us what it meant to imitate, or whether it meant to imitate any thing at all. I need not say this differs widely, for these refuse heaps of ancient villages or stations were compounding terms of course begun at wide intervals. The first and last named no doubt spoke it fluently in some fashion; but they had not the power to analyze it, nor to detect its finer shades of meaning, nor to appreciate many refinements in its word-building, nor to catch many of its semi-notes. In like manner, it was occasionally employed on inanimate matter to decide points of faith or polity. As for our word “luck” itself, it is purely Teutonic and our lexicographers do not trace it beyond its earlier forms. Raphael and Milton seem partial exceptions to this rule. For many years scholars have been divided in opinion whether this was purely ikonographic or partly phonetic. Thieves are also discovered and convicted by these processes, and by another mode known as _Gobereen_, which is a modification of the hot-water ordeal. In smaller instances, when they amount only to a violation of those exact decorums which ought to be observed in the conversation of the two sexes, they cannot indeed justly be considered as violations of the rules of justice. Even then, as we have seen, there may be reason for retaining it. In imagination we become the very person whose actions are represented to us: we transport ourselves in fancy to the scenes of those distant and forgotten adventures, and imagine ourselves acting the part of a Scipio or a Camillus, a Timoleon or an Aristides. Magnanimity, in the same manner, lies in a middle between the excess of arrogance and the defect of pusillanimity, of which the one consists in too extravagant, the other in too weak a sentiment of our own worth and dignity. In most or all of the languages of this stock the root _muk_ or _muc_ means to cover or cover up. TORTURE IN EGYPT AND ASIA. The qualities most useful to ourselves are, first of all, superior reason and understanding, by which we are capable of discerning the remote consequences of all our actions, and of fore-seeing the advantage or detriment which is likely to result from them: and secondly, self-command, by which we are enabled to abstain from present pleasure or to endure present pain, in order to obtain a greater pleasure, or to avoid a greater pain in some future time. We find, further, in the reflex reaction of laughter under tickling, which is observable about the {170} end of the second month, the germ of a sense of fun, or of mirthful play; and this is indicated too in the laughter excited by little pinches on the cheek at the end of the third month. You have the genuine text of nature without gloss or comment. When they approved very much of the motives of his deceit, they have sometimes acquitted him, though, to do the casuists justice, they have in general and much more frequently condemned him. _I love_, _I loved_, _loving_, are all the varieties of termination which the greater part of the English verbs admit of. An exactly similar correspondence exists between an ordinary book and a phonograph record of it read aloud. Better are the crude attempts of native genius which kindle enthusiasm and arouse the best impulses while breaking every canon of art. A man comes into a room, and on his first entering, declares without preface or ceremony his contempt for poetry. Very few men can be satisfied with their own private consciousness that they have attained those qualities, or performed those actions, which they admire and think praise-worthy in other people; unless it is, at the same time, generally acknowledged that they possess the one, or have performed the other; or, in other words, unless they have actually obtained that praise which they think due both to the one and to the other. Therefore it is that the citizens and freemen of London and Westminster are patriots by prescription, philosophers and politicians by the right of their birth-place. The librarian who enters on this plausible path will sooner or later be lost in the jungle. _The Spanish Tragedy_ is bombastic when it descends to language which was only the trick of its age; _Tamburlaine_ is bombastic because it is monotonous, inflexible to the alterations of emotion. Now it is contended that this immediate succession, coexistence or juxtaposition of our ideas is all that can be meant by their comparison. Even indignation at the spectacle of acute suffering needlessly inflicted on animals, where considerations of reciprocal treatment on the part of the animal do not apply, is correctly based on the offence such a “discordance” causes to the ?sthetic sensibility of the cultivated, or the induced sympathetic discomfort of the many. Such a board may be regarded as representative of the great lay public, on whose behalf the institution must be operated, and whose members are interested in results rather than in the special methods by which these results may be obtained. The belief that the judgment of God could be perverted or eluded by magic arts still continued, however, and precautions were commonly taken to prevent their use.[1290] Holy water, moreover, was lavishly sprinkled on the materials employed in the ordeal and on the patient, and was given to him to drink compounding terms to prevent diabolic illusions by which it was imagined that the purposes of God could be defeated.[1291] Precautions also were taken to guard against processes by which, in the fire ordeals, it was believed that the human frame could be rendered incombustible, and for this object a widely prevailing custom required that for three days previous the hand should be wrapped up to guard against its being thus fortified.[1292] The nature of these unguents may be guessed from a prescription given by Albertus Magnus, consisting of mallow and radish juice, white of egg, lime, and “psillus” seeds, the use of which he assures us will enable a man with impunity to enter the flames or to carry red-hot iron.[1293] Doubtless reliance on some such expedients may partially explain the readiness with which the ordeal was undertaken. There is no confusion of ideas, but a beautiful simplicity and uniformity in our relation to each other, we as the slayers, they as the slain. Wearied and distracted with those continual irresolutions, he at length, from a sort of despair, makes the last fatal and irrecoverable step; but with that terror and amazement with which one flying from an enemy, throws himself over a precipice, where he is sure of meeting with more certain destruction than from any thing that pursues him from behind. A red-hot iron ball or spear-head, weighing about two pounds and three-quarters, is then brought, and the judge adjures it— “Thou, O fire, dwellest in the interior of all things like a witness. Though in a particular instance, the circumstances which usually produce those natural affections, as they are called, may, by some accident, not have taken place, yet respect for the general rule will frequently, in some measure, supply their place, and produce something which, though not altogether the same, may bear, however, a very considerable resemblance to those affections. There is no reason why a comedy or tragedy villain should not declare himself, and in as long a period as the author likes; but the sort of villain who may run on in this way is a simple villain (simple not _simpliste_). His detestation of this crime, it is evident, would arise instantaneously and antecedent to his having formed to himself any such general rule. Nothing is more characteristic of the play-mood in young animals and in children alike than an imitative {349} propagation of movement. It is the Christian religion alone that takes us to the highest pinnacle of the Temple, to point out to us ‘the glory hereafter to be revealed,’ and that makes us shrink back with affright from the precipice of annihilation that yawns below. The success of the ordeal thus is uncertain, and his conclusion is that laws must be made for the generality of cases, and not for exceptional ones.[1049] In 1730 thirteen persons were exposed to the cold-water ordeal at Szegedin, in Hungary, and though their guilt was proved by it, any remaining doubts were settled by submitting them to the balance;[1050] and five years later Ephraim Gerhardt alludes to it as everywhere in daily use in such cases.[1051] Even in the middle of the century, the learned and pious Muratori affirms his reverent belief in the miraculous convictions recorded by the medi?val writers as wrought in this manner by the judgment of God; and he further informs us that it was common in his time throughout Transylvania, where witches were very numerous;[1052] while in West Prussia, as late as 1745, the Synod of Culm describes it as a popular abuse in frequent use, and stringently forbids it for the future.[1053] Although, within the last hundred years, the cold-water ordeal has disappeared from the authorized legal procedures of Europe, still the popular mind has not as yet altogether overcome the superstitions and prejudices of so many ages, and occasionally in some benighted spot a case occurs to show us that medi?val ignorance and brutality still linger amid the triumphs of modern civilization. Under the Emperors this method of dying seems to have been, for a long time, perfectly fashionable. Having thus incidently introduced many subjects without their being under any specific head or title, I shall, to enable the reader to form some conception of the matter, give in the contents something like a minute dissection of the whole.
